The basic rules for creating and using your Hispir Care Account.

1. About Hispir Care
Hispir Consulting Ltd., operating as Hispir Care ("Hispir," "we," "us," or "our"), is a private social service provider based in Calgary, Alberta. We support families of children with disabilities and the aides who provide support through Hispir.
These Terms of Use explain the basic rules for creating and using a Hispir Care Account.
2. What these Terms cover
These Terms apply when you:
- create a Hispir Care Account;
- sign in to your Hispir Care Account;
- use general account features; or
- access documents, forms, communications, or tools made available through your Hispir Care Account.
These Terms are the general account terms. They do not replace the separate agreements, privacy documents, consent forms, or policies that apply to a specific role or service.
3. Other documents you may need to accept
Your access to certain services, portals, forms, features, or account functions may be subject to additional terms, policies, agreements, acknowledgements, consents, or requirements presented to you by Hispir.
Those additional terms form part of your agreement with Hispir for the subject matter they cover. More specific agreements, policies, acknowledgements, consents, or requirements apply to the specific role, service, form, feature, or account function they are presented for, while these Terms continue to apply to your general use of your Hispir Care Account.
4. Accepting these Terms
You accept and agree to be bound by these Terms when, during account creation, you check the required acceptance box and select the button or other control that creates your Hispir Care Account.
By accepting these Terms, you also consent to receive and accept Hispir agreements, policies, notices, and records electronically, subject to any additional terms presented to you.
If you do not agree to these Terms, you must not create an account.
When you create an account, you must also accept the Privacy Policy.
5. Eligibility and authority
You must be at least 18 years old to create a Hispir Care Account.
If you create an account as a guardian, you confirm that you have the legal authority to provide information, create care requests, and give consent on behalf of the child connected to your account.
If you create an account as an aide, you confirm that the information you provide about your identity, qualifications, experience, availability, and eligibility to work is accurate.
If you create or use an account on behalf of Hispir as a staff or admin user, you must use your Hispir Care Account only for authorized Hispir purposes.
6. Your account
You are responsible for the account you create. You must:
- provide accurate and current information;
- keep your sign-in credentials confidential;
- use only your own account;
- notify Hispir if you believe your account has been accessed without permission; and
- update your account information when it changes.
You must not share your password or allow another person to use your account.
Hispir may suspend or restrict account access where we believe it is necessary to protect a child, family, aide, Hispir, the Hispir Care Account, or another user.
7. Acceptable use
You must use your Hispir Care Account lawfully, respectfully, and only for its intended Hispir Care purposes.
You must not:
- provide false, misleading, or incomplete information;
- access or try to access another person's account or information;
- interfere with the security or operation of the Hispir Care Account;
- upload malicious code, spam, or harmful content;
- copy, scrape, reverse engineer, or misuse the Hispir Care Account;
- use your account to harass, threaten, exploit, or harm another person;
- use your account to arrange services outside Hispir where that would breach another agreement or policy you have accepted; or
- use your account for any unlawful purpose.
8. No emergency use
The Hispir Care Account is not an emergency tool.
If there is an immediate safety risk, medical emergency, or urgent child-safety concern, call 911 or the appropriate emergency service. Do not rely on the Hispir Care Account, email, forms, or account messages for emergencies.
9. Information you submit
You are responsible for the information, documents, forms, and messages you submit through your Hispir Care Account.
You must make reasonable efforts to ensure that what you submit is accurate, current, and lawful to share.
You must not upload or submit information about another person unless you have the authority or consent needed to do so.
Hispir handles personal information in accordance with the Privacy Policy and, where applicable, the role-specific privacy notice you accept later in your Hispir Care Account.
10. Electronic communications and acceptance
You agree that Hispir may provide agreements, policies, notices, updates, consents, and other records electronically through your Hispir Care Account, email, or another electronic method we make available.
You agree that checking a required acceptance box, selecting an acceptance button, signing electronically, or otherwise confirming acceptance through a Hispir-approved electronic process has the same effect as signing or accepting a paper document.
You are responsible for keeping your email address and contact information current so that we can reach you about your account.
11. Hispir Care Account availability and changes
Hispir may update, change, suspend, or discontinue parts of the Hispir Care Account from time to time. We may also correct errors, change workflows, add or remove features, or adjust how documents are presented.
We try to keep the Hispir Care Account available and useful, but we do not guarantee uninterrupted access.
12. Third-party services and links
The Hispir Care Account may link to third-party tools, forms, scheduling pages, payment systems, sites, or service providers.
Those third parties may have their own terms and privacy practices. Hispir is not responsible for third-party sites or services that we do not control.
13. Hispir content and intellectual property
Hispir owns or has rights to the Hispir Care Account, Hispir name, logos, written materials, forms, templates, and other materials made available by Hispir.
You may use those materials only for your authorized use of Hispir's services. You must not copy, publish, sell, modify, distribute, or use them for any other purpose without Hispir's written permission.
14. Account closure
You may request account closure by contacting Hispir.
Account closure does not affect any agreement, obligation, consent, or right that by its nature is intended to continue after account access ends.
15. Suspension or termination of access
Hispir may suspend, restrict, or terminate your access to the Hispir Care Account if:
- you breach these Terms;
- you breach another Hispir agreement or policy;
- your account appears to be compromised;
- your use creates a safety, privacy, security, legal, or operational concern; or
- continued access is no longer appropriate for your role or relationship with Hispir.
Where practical, Hispir may notify you of the reason. Some situations may require immediate action without advance notice.
16. Disclaimers
The Hispir Care Account is provided on an "as is" and "as available" basis.
Hispir does not guarantee that the Hispir Care Account will always be available, error-free, secure, or compatible with every device or browser.
Nothing in these Terms limits rights or obligations that cannot be limited under applicable law.
17. Limitation of liability
To the fullest extent permitted by law, Hispir is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, goodwill, or opportunity, arising from or relating to your use of, or inability to use, the Hispir Care Account.
To the fullest extent permitted by law, Hispir's total liability for any claim relating to these Terms or to general Hispir Care Account use is limited to the maximum extent permitted under applicable law.
Nothing in these Terms limits liability that cannot be limited by law, or rights, responsibilities, or remedies governed by a more specific agreement you have accepted.
18. Indemnity
You are responsible for losses, claims, damages, costs, or expenses that arise from:
- your breach of these Terms;
- information you submit;
- your misuse of the Hispir Care Account;
- your violation of another person's rights; or
- your unlawful conduct.
You agree to indemnify Hispir for those losses, claims, damages, costs, or expenses, including reasonable legal fees.
19. Changes to these Terms
Hispir may update these Terms from time to time.
If a change is minor, we may post the updated Terms or make them available through your Hispir Care Account or another notice method.
If a change is meaningful, we may ask you to review and accept the updated Terms before continuing to use your account.
The version you accepted governs until a later version is presented and accepted or otherwise takes effect in accordance with these Terms.
20. Governing law
These Terms are governed by the laws of Alberta and the laws of Canada that apply in Alberta.
Any dispute relating to these Terms or general Hispir Care Account use must be brought in the courts of Alberta, unless another agreement you have accepted with Hispir says otherwise or applicable law requires a different forum.
